29 CFR 1926.59:  An employer engaged in construction activities did not comply with the requirements set forth in Part 1910, Section 1200, Hazard Communication:  29 CFR 1910.1200(e)(1): employer had not developed or implemented a written hazard communication program included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii).  On or about April 01, 2019, employees working on a commercial building under construction were exposed to health hazards due to the employer not developing or implementing a written hazard communication program.

29 CFR 1926.451(b)(1): Platform(s) on all working levels of scaffolds, were not fully planked or decked between the front uprights and guardrail supports such that the space between adjacent units, and the space between the platform and the uprights.  On or about April 01, 2019, employees working on a scaffold were exposed to fall hazards greater than 10 feet due to the working levels of the scaffold not being fully planked.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.    On or about April 1, 2019, employees working on a scaffold were exposed to falls greater than 10 feet due to employees not using a ladder when moving more than 2 feet above or below a point of access.

On or about April 01, 2019, employees were exposed to fall hazards due to using a ladder that did not extend at least 3 feet above the roofs landing.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.    On or about, April 1, 2019, employees working on a scaffold, were exposed to fall hazards greater than 10 feet due to not wearing using personal fall arrest systems or having a guardrail system.  Alexandro Valdiviezo was previously cited for a violation of this occupational safety and health standard, 1926.451(g)(1)(vii), which was contained in OSHA inspection number 1262148, citation number 1, item number 2 and was affirmed as a final order on November 14, 2017 with respect to a workplace located at 5372 Doniphan Dr. El Paso TX, 79932.

On or about, April 1, 2019, employees working on a scaffold on a commercial building under construction did not retained the requisite understanding or skill in using fall protection equipment. This condition exposed the employee to fall hazards greater than 10 feet.  Alexandro Valdiviezo was previously cited for a violation of this occupational safety and health standard, 1926.503(c)(3), which was contained in OSHA inspection number 1262148, citation number 1, item number 2 and was affirmed as a final order on November 14, 2017 with respect to a workplace located at 5372 Doniphan Dr. El Paso TX, 79932.
