29 CFR 1926.21(b)(2):  The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury:    At the Francisco Estate job site located on the northwest the corner of Green Avenue and Main Street in Stevens Point, WI; the employer did not instruct a Foreman employee in the recognition and avoidance of situations that could result in possible cave-ins, indications of failure of protective systems, or other hazardous conditions and the regulations applicable to their work environment to control or eliminate any hazards or other exposures to injury when employees installed sewer system components in an excavation.

29 CFR 1926.651(k)(1):  Daily inspections of excavations, the adjacent areas, and protective systems shall be made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. An inspection shall be conducted by the competent person prior to the start of work and as needed throughout the shift. Inspections shall also be made after every rainstorm or other hazard increasing occurrence. These inspections are only required when employee exposure can be reasonably anticipated.  At the Francisco Estate job site located on the northwest the corner of Green Avenue and Main Street in Stevens Point, WI; the employer did not ensure daily inspection of excavations, adjacent areas, and protective systems, for evidence of situations that could result in cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, were made by a competent person. The employer did not designate a competent person for the site and did not ensure those inspections were conducted when employees were exposed to hazards while accessing and working in the site's excavation.

29 CFR 1926.651(c)(2):  A stairway, ladder, ramp or other safe means of egress shall be located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees:    At the Francisco Estate job site located on the northwest the corner of Green Avenue and Main Street in Stevens Point, WI; the employer did not ensure a safe means of egress was located in a trench excavation that was greater than 4 feet in depth. Ladder access was used to enter and exit the trench excavation; however, the ladder was not a safe means of egress because it was located outside the trench box and was not protected from cave-in hazards.

29 CFR 1926.652(g)(1)(ii):  Shields shall be installed in a manner to restrict lateral or other hazardous movement of the shield in the event of the application of sudden lateral loads:    At the Francisco Estate job site located on the northwest the corner of Green Avenue and Main Street in Stevens Point, WI; shields were not installed in a manner to restrict lateral or other hazardous movement of the shield in the event of the application of sudden lateral loads. The trench boxes in the trench excavation were installed with space between the exterior shield walls and the trench walls, which in the event of a cave-in could cause lateral or other hazardous movement of the trench box.
