29 CFR 1926.21(b)(2):The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. On or about October 5, 2022 at location 3130 Rosalie Pkwy, Plover, Wisconsin: the employer did not instruct a Foreman employee in the recognition and avoidance of situations that could result in possible cave ins, indications of failure of protective systems, or other hazardous conditions and the regulations applicable to their work environment to control or eliminate any hazards or other exposures to injury when employees installed water and sewer system components in an excavation. Kyle Kluck Trucking & Excavating, Inc was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.21(b)(2), which was contained in OSHA inspection number 1391207, citation number 1, item number 1/a and was affirmed as a final order on August 13, 2019, with respect to a workplace located at the Francisco Estate job site located on the northwest the corner of Green Avenue and Main Street in Stevens Point, WI.

29 CFR 1926.651(k)(1):Daily inspections of excavations, the adjacent areas, and protective systems shall be made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. An inspection shall be conducted by the competent person prior to the start of work and as needed throughout the shift. Inspections shall also be made after every rainstorm or other hazard increasing occurrence. These inspections are only required when employee exposure can be reasonably anticipated. On or about October 5, 2022 at location 3130 Rosalie Pkwy, Plover, Wisconsin: the employer did not ensure daily inspection of excavations, adjacent areas, and protective systems, for evidence of situations that could result in cave cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, were made by a competent per son. The employer did not designate a competent person for the site and did not ensure those inspections were conducted when employees were exposed to hazards while accessing and working in the site's excavation. Kyle Kluck Trucking & Excavating, Inc was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.21(b)(2), which was contained in OSHA inspection number 1391207, citation number 1, item number 1/b and was affirmed as a final order on August 13, 2019, with respect to a workplace located at the Francisco Estate job site located on the northwest the corner of Green Avenue and Main Street in Stevens Point, WI.
