29 CFR 1910.134(c)(2): The employer did not develop and implement a respiratory protection program in accordance with sections (i) and (ii) of this paragraph (c)(2) for employees who chose to wear respirators where respirator use was not required:    (a) On March 7, 2019 and at dates prior, the employer did not verify that elements of a written respiratory protection program were in place to ensure that any employee using a respirator voluntarily is medically able to use that respirator or provide employees with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that voluntary elastomeric half-face respirator use was permissible. Employees were unaware of the risks that the voluntary use of half-face elastomeric respirators pose and were exposed to undue physiological and psychological stresses that may have put employees at risk of health effects.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:    (a) On and before March 18, 2019, the employer did not develop, implement, or maintain a written hazard communication program. Employees working on the packing lines at the worksite were exposed to various hazardous airborne contaminants in the workplace including, Styrene, N,N-Dimethylanaline, and Acetone.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training as specified in 29 CFR 1910.1200(h)(1), (2), and (3) on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work environment:  (a) On and before March 18, 2019, packing line employees that were exposed to airborne contaminants in the workplace including Styrene, N,N-Dimethylanaline, and Acetone had not been trained on health and physical hazards of the chemicals present in the work area prior to being exposed to hazardous chemicals at the worksite.
