29 CFR 1903.19(d)(1): The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.   The employer failed to submit documentation of abatement within 10 days of the abatement date for Citation 1 Item 1.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   On or about April 8, 2019 employees installing shingles on a residential home at a height greater than six feet were doing so without fall protection.  Esmith Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1348878, citation number 1, item number 1 and was affirmed as a final order on October 31, 2018, with respect to a workplace located at 6012 Red Oak Trail, McFarland, WI 53558.
