29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:  The employer is failing to protect employees from struck-by hazards associated with using pneumatic nail guns without wearing approved eye protection.  This was most recently documented on or about April 8, 2019 at a residential construction site located at 9928 S 73rd Street, Lincoln, NE 68516 where the employer has employees using pneumatic nail guns to secure sheeting they were installing on the roof without wearing any ANSI approved eye protection.

29 CFR 1910.178(l)(2)(ii) is applicable to construction employment as referenced by 1926.602(d): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.  The employer is failing to protect employees from a struck by hazard when operating an all-terrain forklift, powered industrial truck, at a residential construction site. This was most recently documented on or about April 8, 2019 at 9928 South 73rd Street, Lincoln, NE 68516. Operator of the powered industrial truck had not successfully completed the training required by paragraph (l) of the standard. An evaluation of each powered industrial truck operator's performance was not being conducted at least once every three years.   Mielak Rees Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.178(l)(2)(ii) contained in OSHA inspection number 1245520, citation number 1, item number 1, and was affirmed as a final order on September 5, 2017 with respect to a workplace located at 3241 N 94th Street, Lincoln, NE.

This was most recently documented on or about April 8, 2019 at 9928 S 73rd Street, Lincoln, NE 68516 when employees were observed installing sheeting on a residential structure while working at greater than 6 feet above the ground without fall protection.  Mielak Rees Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13) contained in OSHA inspection number 1245520, citation number 1, item number 2, and was affirmed as a final order on September 5, 2017 with respect to a workplace located at 3241 N 94th Street, Lincoln, NE.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards:  The employer failed to train all employees that were potentially exposed to fall hazards to enable each employee to recognize the hazards associated with the type of work being conducted. This was documented on or about April, 8, 2019 at 9928 S 73rd Street, Lincoln, NE 68516.  This should include training on mitigating those hazards through an acceptable method of fall protection. Employees were observed performing framing activities having not received fall protection training.
