29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  a)  At 1316 Tiger Lily Ln., Lots 97  Cottages on the Greene, Foley, Alabama:  On or about April 11, 2019 and at times prior; the employer allowed his employees to perform roof decking and framing activities without first ensuring his employees were trained on the hazards associated with falls to include setting up and inspecting fall protection  exposing his employees to a fall hazard of up to 12.7 feet to the ground below.  b)  At 1320 Tiger Lily Ln., Lots 98  Cottages on the Greene, Foley, Alabama:  On or about April 11, 2019 and at times prior; the employer allowed his employees to perform framing activities without first ensuring his employees were trained on the hazards associated with falls to include setting up and inspecting fall protection  exposing his employees to a fall hazard 9.7 feet to the floor below.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:    a)  At 1316 Tiger Lily Ln., Lot 97  Cottages on the Greene, Foley, Alabama:  On or about April 11, 2019 and at times prior; the employer allowed his employees to use an 6 foot a-frame ladder to gain access to the second floor and the rails of the ladder did not extend three feet above the landing to provide safe access exposing his employees to a fall hazard of 10.6 feet to the ground below.

THE JUAN SALAS DBA JUAN SALAS WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.501(B)(13) WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 1350811, CITATION NUMBER 1, ITEM NUMBER 1, AND WAS AFFIRMED AS A FINAL ORDER ON NOVEMBER 13, 2018, WITH RESPECT TO A WORKPLACE LOCATED AT 31545 SHEARWATER DR., LOT 116 STONEBRIDGE, SPANISH FORT, ALABAMA.
