On or about April 11, 2019, located at 215 Mannaseh Drive West (Lot 132) in Granville, Ohio, the employer did not instruct the employees in the recognition and avoidance of unsafe conditions and the regulations applicable to performing residential framing work, thereby exposing the employees to fall and/or struck-by/caught-between hazards.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. a. On or about April 11, 2019, located at 215 Mannaseh Drive West (Lot 132) in Granville, Ohio, employees were framing a residential home without any means of fall protection, thereby exposing the employees to an approximate fall hazard of 11 feet 6 inches. b. On or about April 11, 2019, located at 215 Mannaseh Drive West (Lot 132) in Granville, Ohio, employees there were no guardrails at the front of a floor hole on the 1st floor, thereby exposing the employees to a fall to the basement of approximately 10 feet. Perez Construction Services, LLC. was previously cited for a violation of this Occupational Safety and Health standard which was contained in OSHA inspection number 1256233, citation number 1, item number 1 and was affirmed as a final order on October 17, 2017, with respect to a workplace located at 7569 Walnut Drive Canal Winchester, Ohio 43110.

If such modifications or changes are made, the capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly. In no case shall the original safety factor of the equipment be reduced. a. On or about April 11, 2019, located at 215 Mannaseh Drive West (Lot 132) in Granville, Ohio, the employer did not obtain manufacturer's written approval and had changes made to the forklift's data plate for the use of fork extensions that were mounted on a Gehl 553 rough-terrain forklift.
