29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  The employer does not protect each employee from the hazard of falling by the use of fall protection systems.  The most recently occurred on or about December 15, 2021, at the job site located at 318-322 Lenell Loop, Delaware, Ohio. The employer failed to ensure that employees who were performing framing work from the top plates of the conjoining residential structure being built were protected from fall hazards while framing in the structure of the building, thereby exposing them to an approximately nine foot fall hazard.  Perez Construction LLC was previously cited for Repeat-Serious violations of this Occupational Safety and Health Standard 1926.501(b)(13), which was contained in OSHA inspection numbers:  1) 1477523, Citation number 2 - Item number 1, Issued on 06/25/2020. 2) 1477515, Citation number 2 - Item number 1, Issued on 06/25/2020. 3) 1392575, Citation number 2 - Item number 1, Issued on 04/19/2019.  Pursuant to 29 CFR 1903.19, the employer must submit documents describing steps it is taking to ensure compliance, including a description of how these steps protect its employees from the fall hazards.

Located at 318-322 Lenell Loop - Building 43, Delaware, Ohio: On or about December 15, 2021, the employer failed to maintain a safety and health program to ensure hazard detection and correction including, but not limited to, fall protection, ladder safety and personal protective equipment, thereby exposing employees to fall and struck-by hazards.  Perez Construction LLC was previously cited for a Serious violation of this Occupational Safety and Health Standard 29 CFR 1926.20(b)(1), which was contained in OSHA inspection number 1477523, citation number 1, item number 1, and was affirmed as a final order on July 24, 2020, with respect to a workplace located at 824 Forest Edge Court, Lot 7219, Marysville, Ohio.

29 CFR  1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a. Located at 318-322 Lenell Loop - Building 43, Delaware, Ohio: On or about December 15, 2021, an employee was utilizing a pneumatic nail gun to secure framing without utilizing eye protection, thereby exposing the employee to struck-by hazards.  Perez Construction LLC was previously cited for a Serious violation of this Occupational Safety and Health Standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 1477515, citation number 1, item number 2, and was affirmed as a final order on July 22, 2020, with respect to a workplace located at 825 Lorenzo Court - Lot 7206, Marysville, Ohio.

Located at the job site at 318-322 Lenell Loop - Building 43, Delaware, Ohio: On or about December 15, 2021, two employees were observed performing framing activities utilizing pneumatic nail guns from the top step of portable ladders, thereby exposing them to fall hazards.  Perez Construction LLC was previously cited for a Serious violation of this Occupational Safety and Health Standard 29 CFR 1926.1053(b)(13), which was contained in OSHA inspection number 1477523, citation number 1, item number 2, and was affirmed as a final order on July 24, 2020, with respect to a workplace located at 824 Forest Edge Court, Lot 7219, Marysville, Ohio.
