29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  The employer does not protect each employee from the hazard of falling by the use of fall protection systems.  The most recently occurred on or about December 15, 2021, at the job site located at 318-322 Lenell Loop, Delaware, Ohio. The employer failed to ensure that employees who were performing framing work from the top plates of the conjoining residential structure being built were protected from fall hazards while framing in the structure of the building, thereby exposing them to an approximately nine foot fall hazard.  Perez Construction LLC was previously cited for Repeat-Serious violations of this Occupational Safety and Health Standard 1926.501(b)(13), which was contained in OSHA inspection numbers:  1) 1477523, Citation number 2 - Item number 1, Issued on 06/25/2020. 2) 1477515, Citation number 2 - Item number 1, Issued on 06/25/2020. 3) 1392575, Citation number 2 - Item number 1, Issued on 04/19/2019.
