29 CFR 1926.1101(d)(4): The employer of employees working adjacent to regulated areas established by another employer on a multi-employer work-site, did not take steps on a daily basis to ascertain the integrity of the enclosure and/or the effectiveness of the control method relied on by the primary asbestos contractor to ensure that asbestos fibers do not migrate to such adjacent areas: (a) 801 Boxwood Road, Wilmington, DE Demolition Site, "Garage Audit Building" Area 4B - On or about March 12, 2019, the employer failed to prevent employee exposure to airborne dust concentrations of asbestos by ascertaining the effectiveness of the control method relied on by the primary asbestos contractor as airborne dust was formed as not intact transite panels were dumped from a bin tipper into a dumpster on the first floor. The panels were then compacted down, being further broken up, by a material handling truck.

Dust was generated as not intact transite panels were dumped from a bin tipper into a dumpster on the first floor, and then compacted down, being further broken up, by a material handling truck.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: (a) 801 Boxwood Road, New Castle, DE Demolition Site, "Garage Audit Building" Area 4B - On or about March 12, 2019, the employer failed to provide information and training on asbestos for employees exposed to airborne asbestos fibers generated as transite panels, containing 15% asbestos, were torn off metal fasteners along a roof parapet, moved down to the second floor and placed into a bin tipper, dumped from the bin tipper into a dumpster on the first floor, and then compacted down, being further broken up, by a material handling truck.
