29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. On or about April 11, 2019, during the removal and installation of roofing material on a residential home located at 8725 West 130th Street, North Royalton, Ohio, the employer did not ensure employees working from the roof were protected from various fall heights of approximately 10 feet to 17 feet or greater, by utilizing a guardrail system, safety net system and/or personal fall arrest system.

On or about April 11, 2019, during the installation of roofing material on a residential home located at 8725 West 130th Street, North Royalton, Ohio, the employer failed to ensure a 12 portable aluminum extension ladder with a broken step (rung) used to access the roof was inspected for visual defects by a competent person.
