29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.   On or about April 11, 2019, during the removal and installation of roofing material on a residential home located at 8725 West 130th Street, North Royalton, Ohio, the employer did not ensure employees working from the roof were protected from various fall heights of approximately 10 feet to 17 feet or greater, by utilizing a guardrail system, safety net system and/or personal fall arrest system.

29 CFR 1926.1053(b)(15): Ladders shall be inspected by a competent person for visible defects on a periodic basis and after any occurrence that could affect their safe use.     On or about April 11, 2019, during the installation of roofing material on a residential home located at 8725 West 130th Street, North Royalton, Ohio, the employer failed to ensure a 12 portable aluminum extension ladder with a broken step (rung) used to access the roof was inspected for visual defects by a competent person.

29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, shall either be immediately marked in a manner that readily identifies them as defective, or be tagged with "Do Not Use" or similar language, and shall be withdrawn from service until repaired.   On or about April 11, 2019, during the installation of roofing material on a residential home located at 8725 West 130th Street, North Royalton, Ohio, the employer failed to ensure employees did not use a 12 portable aluminum extension ladder with a broken step (rung) to access the roof.

The program shall enable each employee to recognize hazards related to ladders and stairways, and shall train each employee in the procedures to be followed to minimize these hazards.   On or about April 11, 2019, during the installation of roofing material on a residential home located at 8725 West 130th Street, North Royalton, Ohio, the employer failed to ensure employees were trained to recognize hazards related to ladders and the procedures to be followed to minimize those hazards while using a 12 portable aluminum extension ladder with a broken step (rung) to access the roof.
