29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.     On and about April 16, 2019, employees were exposed to falls while reroofing a 1.5 story, multiple pitch house when:      A) Employees on the 12:12 pitch roof were not using any form of fall protection to protect themselves from falls from the eaves or gable end;    B) skylights were not covered;    C) employees on the 4:12 roof did not have any form of fall protection at the eave or roof openings.    Buhr Construction Inc. was previously cited for a violation of this occupational safety and health standard which was contained in OSHA inspection number 1157198, citation number 1, item number 1, and was affirmed as a final order on 8/9/16, with respect to a workplace located at 3530 Mayapple Dr. Green Bay, WI 54311.

29 CFR 1926.503(b)(1): The employer shall verify compliance with paragraph (a) of this section by preparing a written certification record. The written certification record shall contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer. If the employer relies on training conducted by another employer or completed prior to the effective date of this section, the certification record shall indicate the date the employer determined the prior training was adequate rather than the date of actual training.  On and about April 16, 2019, employees were exposed to fall hazards while reroofing a 1.5 story, multiple pitch roof when the employer did not ensure documentation of fall protection training was maintained to ensure employees were trained to recognize the actual conditions present.

29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, shall either be immediately marked in a manner that readily identifies them as defective, or be tagged with "Do Not Use" or similar language, and shall be withdrawn from service until repaired.  On April 16, 2019, employees were exposed to falls while accessing and working from extension ladders supporting a ladder jack scaffold when each of the three ladders was missing a foot pad.
