29 CFR 1926.501(b)(14):     Each employee working on, at, above, or near wall openings (including those with chutes attached), where the outside bottom edge of the wall opening was 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches (1.0 M) above the walking/working surface, is not protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system.    a)  5669 Berkshire Valley Road, Oak Ridge, NJ.    Framing employees working on the second floor were exposed to falls of over 15 feet out the several window/wall openings to the ground below as the inside bottom edges of the wall openings were less than 39 inches at 32 inches.                                            Violation occurred on or about 04/15/2019.

29 CFR 1926.503(a)(1):     The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:      a)  5669 Berkshire Valley Road, Oak Ridge, NJ and at the Corporate Offices at 14 Upper Lake Road, Oak Ridge, NJ.    Employees exposed to fall hazards of, but not limited to falls from wall openings, were not provided instruction on fall hazard recognition and on procedures to minimize these hazards.                                            Violation occurred on or about 04/15/2019.

29 CFR 1926.1052(c)(7):     The top edge of a stairrail system served as a handrail and the height of the top edge was less than 36 inches (91.5 cm) from the upper surface of the stairrail system to the surface of the tread, in line with the face of the riser:      a)  5669 Berkshire Valley Road, At the Stairway on the North Side, Oak Ridge, NJ.    Framing employees using the stairway to access the second floor were exposed to falls of up to 13 feet to the ground floor below as the top of the stairrail was only 32 inches from the surface of the stair tread.                                            Violation occurred on or about 04/15/2019.

29 CFR 1926.1052(c)(12):     Unprotected sides and edges of stairway landings were not provided with guardrail systems that meet the criteria contained in Subpart M of 29 CFR 1926:      a)  5669 Berkshire Valley Road, At the Stairway on the North Side, Oak Ridge, NJ.    Framing employees using the stairway to access the second floor were exposed to "over-the-railing" falls of up to 13 feet to the ground floor below as the top landing's guardrail was only 33 1/2" in height and was required to be at least 39" in height as specified in Subpart M by 1926.502(b)(1).                                            Violation occurred on or about 04/15/2019.
