29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:   A)     Miller Family Construction, LLC, conducting work at 882 Timber Wood Court, Waterville, OH 43566: On or about April 17, 2019, the employer did not ensure that employees were protected from head injury hazards by protective hard hats while working below employees who were conducting framing work at the two story residential building. Employees were exposed to potential impact injuries caused by falling materials and/or equipment.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   A)     Miller Family Construction, LLC, conducting work at 882 Timber Wood Court, Waterville, OH 43566: On or about April 17, 2019, the employer did not ensure that employees were protected from fall hazards while conducting wood framing activities atop the two story residential structure. Employees were exposed to approximately 20 feet fall hazard from the roof of the structure to the ground below.

29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided:   A)     Miller Family Construction, LLC, conducting work at 882 Timber Wood Court, Waterville, OH 43566: On or about April 17, 2019, the employer did not ensure that employees were wearing appropriate eye protection such as, but not limited to, safety glasses while conducting framing work with pneumatic nail guns and cutting lumber with circular saws. Employees were exposed to the hazards of eye injury from flying objects.     Miller Family Construction, LLC was previously cited for a violation of this Occupational Safety and Health Standard (29 CFR 1926.95(a)), which was contained in OSHA Inspection # 1006503, Citation number 1, Item number 1, and was affirmed as a final order on 09/01/2016, with respect to a workplace located at 2759 Longview Drive, Maumee, OH 43537.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  A)     Miller Family Construction, LLC, conducting work at 882 Timber Wood Court, Waterville, OH 43566: On or about April 17, 2019, the employer did not ensure that employees had been trained in the appropriate use of fall protection such as, but not limited to, the use of personal fall arrest systems, or alternative measures of fall protection while conducting wood framing activities atop the two story residential structure. Employees did not use fall protection and were exposed to approximately 20 feet fall hazard from the roof of the structure to the ground below.    Miller Family Construction, LLC was previously cited for a violation of this Occupational Safety and Health Standard (29 CFR 1926.503(a)(1)), which was contained in OSHA Inspection # 980011, Citation number 1, Item number 1b, and was affirmed as a final order on 09/01/2016, with respect to a workplace located at 4953 Yosemite Pkwy, Sylvania, OH 43560.
