29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a. On or about March 26, 2019, during sampling performed in one shift for 260 minutes in the metal cutting area, a "cutter" was exposed to a noise dose of 183% or an equivalent TWA of 94 dBA, which was capable of causing permanent hearing loss, and the employer failed to administer a continuing, effective hearing conservation program. b. On or about March 26, 2019, during sampling performed in one shift for 291 minutes in the metal cutting area, a "cutter" was exposed to a noise dose of 136% or an equivalent TWA of 92 dBA, which was capable of causing permanent hearing loss, and the employer failed to administer a continuing, effective hearing conservation program. Canyon Commercial Construction, Inc. was previously cited for a violation of an equivalent Occupational Safety and Health Standard 1910.95(c)(1), which was contained in OSHA inspection number1194319, citation number 1, item number 1-a and was affirmed as a final order on 02-17-2017, with respect to a workplace located at 3440 NW 135th St., Opa Locka, FL.

On or about March 26, 2019, during sampling performed in one shift for 291 minutes in the metal cutting area, a "cutter" that was exposed to a noise dose of 136% or an equivalent TWA of 92 dBA, which was capable of causing permanent hearing loss, and the employer failed to develop and implement a monitoring program. On or about March 26, 2019, during sampling performed in one shift for 260 minutes in the metal cutting area, a "cutter" was exposed to a noise dose of 183% or an equivalent TWA of 94 dBA, which was capable of causing permanent hearing loss, and the employer failed to establish and maintain an audiometric testing program. b. On or about March 26, 2019, during sampling performed in one shift for 291 minutes in the metal cutting area, a "cutter" was exposed to a noise dose of 136% or an equivalent TWA of 92 dBA, which was capable of causing permanent hearing loss, and the employer failed to establish and maintain an audiometric testing program .
