29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a.  Located at 7320 Yarrow Run Road, Plain City, Ohio: On or about April 24, 2019, the employer did not initiate and maintain a Safety and Health Program, for employees performing sheathing work.  The employees were unprotected from the side and edge off the second level of a new build residential home.  The fall distance was approximately 12 feet to the ground.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.   a. Located at 7320 Yarrow Run Road, Plain City, Ohio: On or about April 24, 2019, the employer was not protected from a fall hazard, while installing sheathing to the second level of a new build residential home.  The employer was exposed to a fall hazard of approximately 12 feet, without any means of fall protection.

29 CFR 1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  a. Located at 7320 Yarrow Run Road, Plain City, Ohio: On or about April 24, 2019, the employer did not provide a training program for employees to recognize and provide procedures to be followed, when they might be exposed to a fall hazard.  The employer and employees were exposed to the unprotected side and edge of, the second level on a new build residential home.  The fall distance was approximately 12 feet from the second level to the ground.
