29 CFR  1926.21(b)(2):  The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.  a.  On or about February 16, 2022, the employer failed to instruct the employees on the avoidance of unsafe conditions while an employee installed framing lumber for a new build residential home. The employee was exposed to a fall hazard of approximately 13 feet 7 inches to the lower level as a result.

29 CFR  1926.451(g)(1):  Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers. Note to paragraph (g)(1): The fall protection requirements for employees installing suspension scaffold support systems on floors, roofs, and other elevated surfaces are set forth in subpart M of this part.  a.  On or about February 16, 2022, the employer failed to ensure that the employee was protected from falling when framing lumber was installed off a modified platform of the high reach telehandler forklift onto the new build residential home.  The employee was exposed to a fall hazard of approximately 13 feet 7 inches from the  modified platform to the lower level as a result.

29 CFR  1926.602(c)(1)(ii):  No modifications or additions which affect the capacity or safe operation of the equipment shall be made without the manufacturer's written approval. If such modifications or changes are made, the capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly. In no case shall the original safety factor of the equipment be reduced.  a.  On or about February 16, 2022, an employee worked on top of an uneven stack of OSB sheathing from the forks of the of the Gradall 534C, rough terrain telehandler forklift as a modified working surface to install framing lumber.  The modified working surface was not authorized to raise personnel by the manufacturer for work to be conducted.

29 CFR  1926.20(b)(1):  It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a.  On or about February 16, 2022, the employer did not initiate and maintain a safety and health program to ensure hazard detection and correction, while an employee installed framing lumber for a new build residential home. The employee was exposed to a fall hazard of approximately 13 feet 7 inches  to the lower level as a result.  Jos� Esau Bonilla was previously cited for a serious violation of this occupational safety and health standard 29 CFR 1926.20(b)(1), which was contained in OSHA inspection number 1395843, citation number 1, item number 1 and was affirmed as a final order on June 27, 2019, with respect to a workplace located at 7320 Yarrow Run Road, Plain City, Ohio 43015.
