29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems:    (a)Custom Roofing, Inc. at 8713 West Nikita Drive, Sioux Falls, SD 57106: On or about and at times prior to April 23, 2019, the exposing employer did not ensure employees performing roofing activities on a 6-in-12 pitch roof at heights greater than 6 feet above ground level were protected from fall hazards by use of appropriate fall protection systems. Employees were engaged in reroofing operations without the use of a fall protection system. This condition exposed employees to a fall hazard of approximately 10 feet.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:    (a)Custom Roofing, Inc. at 8713 West Nikita Drive, Sioux Falls, SD 57106: On or about and at times prior to April 23, 2019, the exposing employer did not ensure employees performing roofing activities on a 6-in-12 pitch roof at heights greater than 6 feet above ground level were protected from fall hazards in that, the portable extension ladder used to access the gable end of the roof located at the front of the home was not extended at least 3 feet above the upper landing surface. This condition exposed employees to fall hazards of approximately 10 feet.
