On or about April 29, 2019, in the Boiler Room, the employer did not ensure a floor hole was properly guarded in that a section eight (8) inches in width was left exposed, and the board being used was not secured from movement.

29 CFR 1910.1053(c): The employer did not ensure that no employee was exposed to an airborne concentration of respirable crystalline silica in excess of 50 microgram per cubic meter, calculated as an eight-hour time weighted average.    a) On or about April 29, 2019, an employee working in the Loading Platform Area was exposed to an 8-hour time weighted average concentration of 260 micrograms per cubic meter of respirable crystalline silica which exceeded the permissible exposure limit by 520% during a sample period of 316 minutes. Zero exposure was used for the unsampled portion of the shift.    b) On or about May 24, 2019, an employee working in the Loading Platform Area was exposed to an 8-hour time weighted average concentration of 86 micrograms per cubic meter of respirable crystalline silica which exceeded the permissible exposure limit by 172% during a sample period of 465 minutes. Zero exposure was used for the unsampled portion of the shift.    c) On or about May 24, 2019, an employee working in the Loading Platform Area was exposed to an 8-hour time weighted average concentration of 103 micrograms per cubic meter of respirable crystalline silica which exceeded the permissible exposure limit by 206% during a sample period of 450 minutes. Zero exposure was used for the unsampled portion of the shift.    d) On or about May 24, 2019, an employee working in the Loading Platform Area was exposed to an 8-hour time weighted average concentration of 476 micrograms per cubic meter of respirable crystalline silica which exceeded the permissible exposure limit by 952% during a sample period of 357 minutes. Zero exposure was used for the unsampled portion of the shift.

29 CFR 1910.178(m)(2): Employee(s) stood under or passed under the elevated portion of a powered industrial truck(s):    On or about 4/29/2019, on the Bulk Bag Loading Platform, employees positioned themselves under the forks of a powered walk-behind fork truck which was being used as an additional support for bulk sacks suspended by a hoist. Employees reached under the forks to untie 2000 pound bulk bags during mixer loading.
