29 CFR 1903.19(c)(1): The employer did not certify to OSHA, within 10 calendar days after the abatement date, that the cited violation had been abated: On or about October 18, 2019, the employer failed to certify to OSHA that the following hazards have been abated: (a) Citation 1, Item 1a - On May 2, 2019, and times prior thereto, at the jobsite, an employee ascended and descended from the rooftop on an aluminum extension ladder, which did not extend at least three feet above the rooftop landing, exposing the employee to fall hazards greater than 6 ft. to the ground below. (b) Citation 1, Item 1b - On May 2, 2019, and at times prior thereto, at the jobsite, an employee used a Louisville aluminum extension ladder to ascend and descend from the rooftop, while using the anti-slip safety shoes/feet in a tip-toed position to prevent slipping on the slippery surface. (c) Citation 2, Item 1 - On May 2, 2019, and at times prior thereto, at the jobsite, an employee was observed using Hitachi pneumatic nail gun without the use of eye protection.
