29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles:  New residential construction located on Lot #31, Front side: On or about 05/02/2019, and at times prior, the employer exposed employees to struck-by hazards while operating pneumatic nail guns at 120 PSI, in that protective eyewear was not provided to employees operating these tools while installing Hardie-Board Siding.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section:  New residential construction located on Lot #31, Front side: On or about 05/02/2019, and at times prior, the employer exposed employees to fall hazards of 22-feet, 10-inches to the lower level, in that a personal fall arrest system was not connected to the life-lines provided while installing siding from a pump jack scaffold system.   Arnol Martinez was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(g)(1)(vii), which was contained in OSHA inspection number 1338700, citation number 1, item number 1 and was affirmed as a final order on 11/01/2018, with respect to a workplace located at Lot #1 Belmont Blvd., Village of Belmont Cottages, Smyrna, GA 30080.

29 CFR 1926.403(b)(1): Employer did not ensure that electrical equipment is free from recognized hazards that are likely to cause death or serious physical harm to employees:  New residential construction located on Lot #31, Front side: On or about 05/02/2019, and at times prior, the employer failed to inspect all of the electrical cords and equipment prior to the start of the work shift, in that a 50-ft. extension cord used to power two circular saws had a damaged/torn outer casing and damaged strain relief which exposed the internal insulated wires and was not repaired or removed from service.
