29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s): On or about 05/07/2019, T. S. Banze Construction Inc., working at a commercial site located at 1680 Hwy K, OFallon, MO, were breaking concrete at or near a conduit with had energized lines. An incident occurred which caused an electrical flash and disrupted the power. The employer did not conduct an adequate inspection of the job site, materials, and equipment for the job to be performed.

29 CFR 1926.416(a)(1): Employees were permitted to work in proximity to electric power circuits and were not protected against electric shock by de-energizing and grounding the circuits or effectively guarding the circuits by insulation or other means: On or about 05/07/2019, T. S. Banze Construction Inc., working at a commercial site located at 1680 Hwy K, OFallon, MO, were breaking concrete at or near energized conduit line. The circuit was not deenergized nor any other special precautions taken. An incident occurred which caused an electrical flash and disrupted the power.
