Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employees a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that, employees were exposed to the hazard of being struck by and/or crushed by rail cars should the homemade supports fail during work activities in, under, or around supported rail cars: a.) The Hill Railroad Car Company, Inc., Railcar track areas, On or about May 9th, 2019 and times prior thereto: Employees were exposed to potential struck-by and crush-by hazards in that, employees were utilizing homemade metal supports to support rail cars. Employees worked under, around, inside, and ton top of the railcars. The supports had not been load tested, rated for capacity or inspected. The metal supports had not been proof tested nor did they have any rated capacity markings or other identifying markings.

The Hill Railroad Car Company, Inc., Southeast exit next to rail car track #4/oxygen refill area, On or about May 9th, 2019 and times prior thereto: Five compressed gas cylinders of oxygen (180 liters) were free standing and were not secured by any device to prevent the cylinders from falling, rolling, or getting knocked over. b.) The Hill Railroad Car Company, Inc., Area between rail car track #3 and rail car track #4, On or about May 9th, 2019 and times prior thereto: One propane cylinder, one oxygen cylinder, and one carbon dioxide cylinder were free standing and were not secured by any device to prevent the cylinders from falling, rolling, or getting knocked over.

The Hill Railroad Car Company, Inc., Various areas throughout the rail track area, on or about May 9th, 2019 and times prior thereto: Employees used cloth rags for the purpose of cleaning up flammable materials including, but not limited to, paints and oils. A metal receptacle for disposal of the used oil and lubrication rags was not provided for employees.
