29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: On or about May 21, 2019 a hearing conservation program was not administered to employees exposed to noise levels exceeding 85.0 dBA, as an 8 hour time weighted average. a. The grind/mill employee was exposed to 93.3 dBA, as an 8 hour TWA. Employee was sampled on May 21, 2019 and was sampled for 349 minutes, the remaining 131 minutes was calculated as 0 (zero) exposure time. b. The employee manually tapping material was exposed to 87.1 dBA, as an 8 hour TWA. Employee was sampled on May 21, 2019 and was sampled for 290 minutes, the remaining 190 minutes were calculated as 0 (zero) exposure time.
