29 CFR 1926.501(b)(1): "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. On May 7, 2019, at 1 E. Main St. Fairborn, a brick building, two employees were exposed to a 20 ft. fall hazard while on a flat roof performing caulk removal, tuck pointing, on the parapet wall 24 inches in height without utilizing a lanyard/retractable and an anchorage point.

29 CFR 1926.502(a)(2): Employers shall provide and install all fall protection systems required by this subpart for an employee, and shall comply with all other pertinent requirements of this subpart before that employee begins the work that necessitates the fall protection. On May 7, 2019, at 1 E. Main St. Fairborn, a one-story brick building, the employer had not installed a fall protection system before the employees began their work removing caulk and tuck pointing on the flat roof top of the parapet wall with a height of 24 inches and exposed to at least a 20 ft. fall hazard.
