29 CFR 1926.451(b)(1)(i): Each platform unit (e.g., scaffold plank, fabricated plank, fabricated deck, or fabricated platform) was not installed so that the space between adjacent units and the space between the platform and the uprights were no more than 1 inch (2.5 cm) wide, except where the employer can demonstrate that a wider space is necessary. On or about June 26, 2025, the employer, Trisco Systems, Incorporated at the jobsite located at 8200 W State Route 163, Oak Harbor, OH 43449, did not ensure that employees were protected from falls while working atop a partially planked tubular welded scaffold system. Employees performing brick and mortar removal on a commercial building from the tubular welded frame scaffold system were exposed to potential fall and slip/trip/fall hazards of approximately 6 feet or greater to the ground below.

29 CFR 1926.1153(c)(1): For each employee engaged in a task identified in Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section. On or about June 26, 2025, the employer did not implement the engineering controls listed in Table 1 for handheld powered chipping tools when working with materials containing crystalline silica such as mortar, and bricks. Employees used a handheld chipping tool to remove bricks and mortar on the buildings exterior wall without the use of a dust collection system or water delivery system that continuously feeds water to the point of impact.
