29 CFR 1910.178(l)(6): The employer did not certify that each operator has been trained and evaluated as required by this paragraph (l):  (a) New residential construction on Lot #11, Across the street laydown area: On or about 05/14/2019, and at times prior, the employer allowed employees to operate rough terrain powered industrial forklift trucks without certification, evaluation, and training on the type of truck they were operating.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   (a) New residential construction located on Lot #11, 3rd level: On or about 05/14/2019, and at times prior, the employer exposed employees to fall hazards of 23-feet, 3-inches to the lower level, in that a fall protection system was not provided by the employer prior to the start of work while employees engaged in framing activities.
