Note: This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 1247469, Citation 1, Item 1, and was affirmed as a final order on August 30, 2017 with respect to a workplace located in the vicinity of 1201 South 12th Street in Bismarck, North Dakota.

29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety: (a) On or about May 15, 2019 for the employee who was exposed to crushing hazards from trench cave-ins while cutting a pipe in a nine foot deep excavation where the competent person did not ensure an adequate means of egress was provided and did not measure the trench to verify the sloping and benching system would protect the employee at the corner of Prairie Hills Road & Fourth Avenue Watford City, North Dakota. Note: This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 1247469, Citation 1, Item 2a, and was affirmed as a final order on August 30, 2017 with respect to a workplace located in the vicinity of 1201 South 12th Street in Bismarck, North Dakota.
