29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury. Employer is failing to ensure that employees are instructed on working conditions and regulations associated with the work being performed. This was most recently observed on May 20, 2019 at or near 13820 Tregaron Ridge, Bellevue, NE 68123. A Telehandler unit was driven over uneven terrain (slit trench) while backing in reverse, turning, and lowering the boom arm, when the uneven terrain caused the tip over.

29 CFR 1926.602(a)(3)(i): No employer shall move or cause to be moved construction equipment or vehicles upon any access roadway or grade unless the access roadway or grade is constructed and maintained to accommodate safely the movement of the equipment and vehicles involved. The employer is failing to ensure that construction equipment roadways or grades are maintained to allow safe movement of the vehicles. This was most recently observed on May 5, 2019 at or near 13820 Tregaron Ridge, Bellevue NE. Uneven terrain was present when the telehandler unit was loading and unloading materials on ground surface that did not provide a smooth and level surface.
