29 CFR  1926.20(b)(2):The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them:  (a)Paxton Contracting, LLC at 3276 Jim Street, Rapid City, SD 57703: On or about and at times prior to January 20, 2023, the exposing employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Employees were conducting framing operations on a commercial property without the use of a fall protection system, not using properly installed ladders while accessing and egressing the top plates of framed walls, and a lack of Personal Protective Equipment (PPE).  This condition exposed employees to fall and struck-by hazards.

29 CFR  1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles:  (a)Paxton Contracting, LLC at 3276 Jim Street, Rapid City, SD 57703: On or about and at times prior to January 20, 2023, the employer did not ensure that each employee that was installing floor joists and sheathing with the use of a pneumatic nail gun was protected from flying particles by the use of appropriate eye protection.  This condition exposed employees to struck-by hazards.

This condition exposed the employees to fall hazards greater than six feet.

29 CFR  1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladders side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  (a)Paxton Contracting, LLC at 3276 Jim Street, Rapid City, SD 57703: On or about and at times prior to January 20, 2023, the exposing employer did not ensure that the Werner 10-foot Fiberglass A-frame step ladders, Model Number NXTIA-10 ladders that the employees were using were extended at least three feet above the upper landing surface of the framed wall top plates of a multi-family residential apartment building.  This condition exposed employees to fall hazards greater than six feet.

29 CFR  1926.1053(b)(13):The top or top step of a stepladder was used as a step:  (a)Paxton Contracting, LLC at 3276 Jim Street, Rapid City, SD 57703: On or about and at times prior to January 20, 2023, the employer did not ensure that two Werner, 10 foot, 300 lbs. Fiberglass Stepladders, Model Numbers: NXTIA-10, the employees were using to access the upper landing surface of the east top plates of the commercial building framed walls were installed and used correctly in that employees were permitted to stand on the top or top step of the stepladders while they were leaning against the east wall of the multi-family residential building. This condition exposed employees to fall hazards greater than six feet.
