29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: a) Worksite: The employer did not ensure that the machine guarding on the FitzMill Comminuting Machine Model D adequately protected employees from hazards during the operation cycle; on or about 5/16/16. b) Worksite: The employer did not ensure that FitzMill Comminuting Machine Model D rotating belts were guarded adequately from both sides to protect employees from being exposed to ingoing nip points; on or about 5/16/19. Note: In addition to abatement certification the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.

29 CFR 1910.212(a)(3)(iii): Special hand tools for placing and removing material(s) were used in lieu of other guarding required by this section, permitting the operator to place a hand in the danger zone: a) Worksite: Employees were provided with hand tools for unclogging from and moving materials through the point of operation. The hand tools were used in lieu of guarding. The employer did not ensure FitzMill Comminuting Machine Model D was guarded to prevent employees from having any part of their body enter into the danger zone during the operation cycle; on or about 5/16/19. Note: In addition to abatement certification the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.
