29 CFR 1926.502(d)(17): The attachment point of the body harness was not located in the center of the wearer's back near shoulder level, or above the wearer's head: (a)Rise to the Top Construction, LLC at 509 South Whitewood Avenue, Sioux Falls, SD 57106: On or about and at times prior to May 13, 2019, the exposing employer did not ensure that employees performing roofing work at heights greater than 6 feet above ground level were protected from fall injuries in that the attachment point to the body harness for some users was not located in the center of the wearer's back near shoulder level.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employees provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a)Rise to the Top Construction, LLC at 509 South Whitewood Avenue, Sioux Falls, SD 57106: On or about and at times prior to May 13, 2019, the exposing employer did not ensure that employees performing roofing work at heights greater than 6 feet above ground level were protected from fall hazards by use of appropriate fall protection systems. This condition exposed employees to fall hazards. Rise to the Top Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13) which was contained in OSHA inspection number 1281904, citation number 1, item number 1 and was affirmed as a final order on March 22, 2018, with respect to a workplace located at 21518 Parkview Drive, Gretna, NE 68028.
