(a)  Southeast corner of excavation, while building forms and rebar assemblies:   On or prior to 5/9/19, employees were exposed struck-by hazards from a rebar bundle placed within 2' of the edge of the excavation.

Employees were exposed to cave-in and struck-by hazards while working in an inadequately protected excavation which was approximately 6 to 13 feet deep.

29 CFR 1904.39(a)(2): The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation or the loss of an eye.  Worksite, 7 Garfield Road, Monroe, NY:   On or prior to 4/8/19, the employer did not report an occupational injury to Jose Godinez Lopez which resulted in hospitalization; injury occurred on or about 4/8/19 at the 7 Garfield Road jobsite when the employee was struck in the lower leg by a rock which fell from an unprotected excavation face.
