29 CFR 1910.132(h)(1): The employer did not provide the protective equipment, including personal protective equipment (PPE), used to comply with this part, at no cost to employees: a) 80 Summit Road, Chestnut Ridge, NY (aka 215 Schoolhouse Road, Chestnut Ridge, NY) - High School Building Under Construction - Rooftop: On or about 3/4/25, the employer did not provide work gloves at no cost to employees who were exposed to cuts/lacerations when handling metal rebar and wire mesh. b) 80 Summit Road, Chestnut Ridge, NY (aka 215 Schoolhouse Road, Chestnut Ridge, NY) - High School Building Under Construction - Rooftop: On or about 3/4/25, the employer did not provide chemical protective gloves when spraying foam insulating sealants onto roof surfaces (e.g., Great Stuff Gap Sealer and Great Stuff Gaps and Cracks) which contained diphenylmethane diisocyanate and 4,4' -methylenediphenyl diisocyanate. The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19, failure to comply will result in additional penalty of $ 1,000.00.

29 CFR 1926.502(b)(1): The top edge height of the top rails, or equivalent guardrail system members, was not 42 inches (1.1 m) plus or minus 3 inches (8 cm) above the walking/working level: a) 80 Summit Road, Chestnut Ridge, NY (aka 215 Schoolhouse Road, Chestnut Ridge, NY) - High School Building Under Construction: On or about 3/4/25, employees tying in rebar to dowels at the edge of the roof and employees spraying insulating foam sealant were exposed to a fall hazard (approximately 40 feet) as the top rails of the perimeter guardrail system were inadequate as they ranged from approximately 52 to 55 inches in height. Because abatement of this violation is already documented in the inspection file, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.
