29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace. A) Rodrigo RN Construction LLC on or about May 30, 2019 at the address of 4436 Navarre Avenue, OH: The employer failed to ensure that an employee operating a fork truck was adequately trained. Untrained forklift operators are a hazard to other employees working in the direct vicinity, such as not ensuring the load is properly placed on the forks and the inability to read the load chart, exposing employees to crushing and struck by hazards.
