29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a.  On or about September 28, 2020, located at 2791 Brandon Road, Lot#20-2014, Upper Arlington, Ohio: the employer did not maintain a safety and health program to ensure hazard detection, and correction while performing framing work onsite.  An employee worked unprotected from the rooftop of a new build residential home without any means of fall protection.  The fall distance was approximately 16 feet to the ground.

On or about September 28, 2020, located at 2791 Brandon Road, Lot#20-2014, Upper Arlington, Ohio: the employer failed to instruct employees on the avoidance of unsafe conditions while they performed framing work onsite.  An employee worked unprotected from the rooftop of a new build residential home without any means of fall protection.  The fall distance was approximately 16 feet to the ground.

29 CFR 1926.1053(b)(4): Ladders shall be used only for the purpose for which they were designed.  a.  On or about September 28, 2020, located at 2791 Brandon Road, Lot#20-2014, Upper Arlington, Ohio, the employer did not use the fiberglass ladder for the purpose for which it was designed for.  An employee had used the ladder that was in its folded position for storage, to gain access to the rooftop above the second floor level.  The employee was therefore exposed to falls at approximately 11 feet 8 inches from the eave of the first floor level rooftop.

On or about September 28, 2020, located at 2791 Brandon Road, Lot#20-2014, Upper Arlington, Ohio, the employer did not ensure that the ladder used on top of the second floor level roof top was used on a stable and level surface.  An employee had used the ladder to gain access to the rooftop above the second floor level.  The employee was therefore exposed to falls at approximately 11 feet 8 inches from the eave of the first floor level rooftop.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers.  a. On or about September 28, 2020, located at 2791 Brandon Road, Lot#20-2014, Upper Arlington, Ohio, the employer failed to ensure that an employee who worked on top of a makeshift scaffold platform from the rooftop of the second floor level of a new build residential home was protected from falling to the ground level. The employee was therefore exposed to falls at approximately 16 feet from the eave of the roof top the ground level.   Rodrigo RN Construction LLC, was previously cited for an equivalent Occupational Safety and Health standard, which was contained in OSHA inspection number 1404532, citation number 1, item number 2 and was affirmed as final order on September 12, 2019, with respect to a workplace located at 4436 Navarre Road, Oregon, Ohio 43616.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.   a. On or about September 28, 2020, located at 2791 Brandon Road, Lot#20-2014, Upper Arlington, Ohio, the employer failed to ensure that an employee who worked on top of the second floor level of a new build residential home was protected from falling to the ground level.  The employee was therefore exposed to falls at approximately 16 feet from the eave of the roof top the ground level, without fall protection.
