29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  Jobsite:  On or about June 3, 2019, the ground man was not wearing a hard hat.  Employees were working on the roof with hand and power tools.

29 CFR 1926.503(c): When the employer has reason to believe that any affected employee who has already been trained does not have the understanding and skill required by paragraph (a) of this section, the employer is to retrain each such employee such as inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding of skill:   (a)  Jobsite:  On or about June 3, 2019, four employees who were working on the roof need to be retrained so that they retain the knowledge and skill needed to minimize the hazards of falling off of a roof when doing roofing work.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   (a)  Jobsite:  On or about June 3, 2019, four employees were doing residential roofing work (installing shingles) and they were not protected from falling to the ground.  The pitch of the roof was about 8 in 12 and the fall hazard to the employees was up to about 20 feet.

29 CFR 1926.102(a)(1): 29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles:   (a)  Jobsite:  On or about June 3, 2019, employees were not wearing eye protection when operating pneumatic nail guns to install asphalt shingles on the roof.    The Jose Garcia was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 1307055, citation number 1, item number 1 and was affirmed as a final order on May 25, 2018, with respect to a workplace located at 641 Guenevere Drive, Pittsburgh, PA.

29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them:   (a)  Jobsite:  On or about June 3, 2019, the employer did not ensure that safety protocols were followed during roofing activities.  Examples of this were that no one was protected from falling to the ground from the roof, there were no lanyards nor rope grabs on the site for employees to use and there were no hard hats on the site for the ground man to wear.    The Jose Garcia was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.20(b)(2), which was contained in OSHA inspection number 1307055, citation number 2, item number 1 and was affirmed as a final order on May 25, 2018, with respect to a workplace located at 641 Guenevere Drive, Pittsburgh, PA.
