29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59)     A written hazard communication program was not developed for employees using hazardous chemical products such as but not limited to Portland cement,  Sika Concrete Bonding Adhesive, Kleen Strip paint thinner, and paint (Benjamin Moore, Do it Best).  Employees were exposed to chemical hazards.

Safety Data Sheets (SDS) were not maintained on site for various types of paints, thinner, Portland cement, and adhesive the employees were using.  Employees were exposed to chemical hazards.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: (Construction Reference: 1926.59)      Training was not provided to for employees that used hazardous chemical products such as but not limited to Portland cement,  Sika Concrete Bonding Adhesive, Kleen Strip paint thinner, and paint (Benjamin Moore, Do it Best). 29 CFR 1926.701(b): All protruding reinforcing steel, onto and/or into which employees could fall or come against, was not guarded to eliminate the hazard of impalement:    Numerous rebar protruding from 3"- 24" above ground were not guarded where employees placed form work and walked. Employees were exposed to impalement hazards.
