29 CFR 1926.1101(k)(1)(ii): The employer did not include asbestos in the program established to comply with the Hazard Communication Standard (HCS) and ensure each employee was trained in accordance with the provisions of the HCS and paragraphs (k)(9) and (10) of 29 CFR 1926.1101. The employer did not provide information on at least the following hazards: Cancer and lung effects.     (a) Summit Communities, LLC., at 300 Russell Blvd, Thornton, CO: On and around June 10, 2019, the employer did not ensure that each employee was trained in hazards associated with asbestos to comply with the Hazard Communication Standard. Employees worked as maintenance technicians for an apartment complex. Textured surfacing material samples contained greater than 1% asbestos. This condition exposed employees to airborne asbestos fibers.

29 CFR 1910.1200(h)(1):  The employer did not provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets.   (a) Summit Communities, LLC., at 300 Russell Blvd, Thornton, CO: On and around June 10, 2019, the employer did not provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees have not previously been trained about is introduced into their work area. Employees worked as maintenance technicians for an apartment complex. The employees were exposed to chemical hazards associated with the use of cleaning chemicals, pool chemicals, and paint.  Note: The requirements applicable to the construction standard under this section are identical to those set forth in 29 CFR 1926.59.

29 CFR 1926.1101(k)(9)(v): Training for Class III employees was not consistent with EPA requirements for training of local education agency maintenance and custodial staff as set forth at 40 CFR 763.92(a)(2):    (a) Summit Communities, LLC., at 300 Russell Blvd, Thornton, CO: On and around June 10, 2019, the employer did not provide training for custodial staff performing Class III work as set forth at 40 CFR 763.92(a)(2). Employees worked as maintenance technicians for an apartment complex. Textured surfacing material samples contained greater than 1% asbestos.  This condition exposed employees to airborne asbestos fibers.

29 CFR 1910.134(k)(6): The employer did not provide the basic advisory information on respirators, as presented in Appendix D of this section, in any written or oral format to employees who wear respirators when such use is not required by 29 CFR 1910.134 or by the employer:  (a) Summit Communities, LLC., at 300 Russell Blvd, Thornton, CO: On and around June 10, 2019, the employer did not provide the basic advisory information on respirators, as presented in Appendix D of 29 CFR 1910.134, in any written or oral format to employees who wear respirators when such use is not required by this section or by the employer. Employees worked as maintenance technicians for an apartment complex. The employer allowed employees to voluntarily wear particulate filtering facepiece respirators (dust masks). The employer had not provided the basic advisory information on respirators.  This condition potentially exposed employees to a respiratory hazard.  Note: The requirements applicable to the construction standard under this section are identical to those set forth in 29 CFR 1926.103.
