29 CFR 1926.651(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c): (a)H&W Contracting, LLC at 69th Street & Medical Court Sioux Falls, SD 57107: On or about and at times prior to June 12, 2019, the exposing employer did not ensure employees were protected from cave-in and struck-by hazards while working within an excavation deeper than five feet. An employee jumped down into an area of the excavation located above the trench box, which was greater than five feet in depth and unprotected, within an excavation approximately 13 feet in depth. The employee accessed the excavation to provide a grinder to an employee working within a trench box. The condition exposed an employee to a cave-in and struck-by hazard associated with accessing an unprotected area above a trench box located within the excavation.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems: (a)H&W Contracting, LLC at 69th Street & Medical Court Sioux Falls, SD 57107: On or about and at times prior to June 12, 2019, the exposing employer did not ensure that daily inspections of a trench that was approximately 13 feet in depth were made by the competent person for evidence of a situation that could have resulted in a hazardous condition. The competent person did not identify that the trench was greater than five feet in depth, had near vertical walls on the east and west ends, was undercut on the west end near the bottom and had a gap of approximately 2 feet between the inner wall of the trench box and the plate steel shield on the east end. This condition exposed employees to struck-by hazards and crushing injuries associated with trench wall cave-in.

29 CFR 1926.1053(b)(4): Ladders were used for purposes other than the purposes for which they were designed: (a)H&W Contracting, LLC at 69th Street, Sioux Falls, SD 57107: On or about June 12, 2019, the employer did not ensure employees were using a Louisville extension ladder for the purposes for which they were designed. An employee was utilizing the top section of an extension ladder to access and egress from a trench box. The manufacturer specifically indicates that it is unsafe to use the top section of an extension ladder based on the section was not equipped with feet to stabilize the ladder. This condition exposed employees to a fall hazard of approximately 12 feet.
