29 CFR1926.652(b)(2): Maximum allowable slopes, and allowable configurations for sloping and benching systems, was not determined in accordance with the conditions and requirements set forth in Appendices A and B to this subpart: (a)H & W Contracting, LLC at 2409 West Main Street, Mitchell, SD 57301: On or about and at times prior to July 21, 2025, the employer did not ensure that adequate benching was in place prior to an employee working within a trench excavation that contained inadequately benched north and south walls. This condition exposed an employee to cave-in and struck-by hazards associated with trench wall collapse.
