29 CFR 1910.119(h)(3)(ii): The contract employer did not assure that each contract employee was instructed in the known potential fire, explosion, or toxic release hazards related to his/her job and the process, and the applicable provisions of the emergency action plan: (a) Femco Holdings LLC, at 67509 Weld County Road 71, Grover, CO: On and preceding 6/5/19, the contract employer did not assure that each contract employee was instructed in the known potential fire, explosion, or toxic release hazards related to his/her job and the process, and the applicable provisions of the emergency action plan. Femco Holdings LLC was hired to perform contract work at a gas plant. The gas plant contained highly hazardous chemicals in excess of the threshold quantity for flammable gases or liquids. The gas plant was a PSM facility. Femco Holdings LLC did not assure that each of its employees was instructed on the hazards related to their jobs and the process and the provisions of the facility emergency action plan. This condition exposed five employees to fire, explosion, and chemical hazards.

Femco Holdings LLC was hired to perform contract work at a gas plant. The gas plant contained highly hazardous chemicals in excess of the threshold quantity for flammable gases or liquids. The gas plant was a PSM facility. Femco Holdings LLC did not assure that each of its employees followed the safety rules of the facility including the safe work practices required by paragraph (f)(4) of this section, including but not limited to de-energization and isolation procedures. This condition exposed five employees to fire, explosion, and chemical hazards.

Femco Holdings LLC was hired to perform contract work at a gas plant. Femco Holdings LLC did not ensure that its written hazard communication program as implemented included the methods used to provide on-site access to SDSs for each hazardous chemical brought to the site by Femco Holdings LLC that other employers' employees may be exposed to while working at the multi-employer worksite. Hazardous chemicals brought to the gas plant by Femco Holdings LLC included, but were not limited to the following: 1. Oxygen; 2. Acetylene; 3. Diesel fuel; 4. Welding rods; and 5. WD-40 Company WD-40.
