29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles:  a) New residential construction located on Lots #30 & #31, Front porch: On or about 06/11/2019, and at times prior, The employer exposed employees to struck-by hazards while operating a STHIL (Model TS-420) 14-inch Cut-Off Saw and a DeWalt (Model-DWE402) 4-1/2-inch grinder without protective eyewear cutting a blue stone patio.

29 CFR 1926.300(b)(1): Power operated tool(s), designed to accommodate guards, were not equipped with such guards when in use:   a) New residential construction located on Lots #30 & #31, Front porch: On or about 06/11/2019, and at times prior, The employer exposed employees to struck-by and amputation hazards while operating a DeWalt (Model DWE402) 4-1/2-inch angle grinder without a guard over the diamond masonry grinding wheel.

29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section.  a) New residential construction located on Lots #30 & #31, Front porch: On or about 06/11/2019, and at times prior, the employer exposed employees to silica exposure while cutting blue stone, in that the STIHL 14-inch cut-off saw equipped with integrated water delivery system was not used while dry cutting stone patio.  b) New residential construction located on Lots #30 & #31, Front porch: On or about 06/11/2019, and at times prior, the employer exposed employees to silica exposure while cutting blue stone, in that the DeWalt 4-1/2-inch angle grinder was not equipped with a shroud and dust collection system.

29 CFR 1926.1153(d)(2)(i): The employer did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2)(ii) or the scheduled monitoring option in paragraph (d)(2)(iii) of this section:  a) New residential construction located on Lots #30 & #31, Front porch: On or about 06/11/2019, and at times prior, employees were permitted to perform outdoor blue stone cutting operations on the front porch using a STIHL 14-in. cut-off saw and a DeWalt 4-1/2-in. angle grinder as other employees were permitted to walk and work in close proximity to the cutting area.
