29 CFR 1926.28(a): The employer is responsible for requiring the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions or where this part indicates the need for using such equipment to reduce the hazards to the employees.   Ground Level:  Employees were observed chipping concrete without wearing hearing protection, safety shoes, and with only one strap of the 3M N95 respirator in place.   Employees were exposed to the hazard of hearing loss, foot injury, and health hazards associated with potential exposure to respirable crystalline silica dust.

29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section:                Ground Level:  Employees chipped the concrete foundation both inside and out of a structure with handheld powered chipping tools without an integrated water delivery system or dust collection system as specified in Table 1 of this standard.  Nor had the employer assessed exposure to respirable crystalline silica in the workplace.  Employees were exposed to the health hazards associated with respirable crystalline silica dust.
