29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program, as described in paragraphs (c) through (o) of this section, whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level (TWA) of 85 decibels measured on the A scale (slow response) or, equivalently, a dose of fifty percent:  a) At the site, on or about June 25, 2019, the employer did not provide a hearing conservation program for employees who were exposed to a time weighted average (TWA) of 91.0 decibels on the A scale (dBA) or an equivalent dose of 114.1% for a run time of 390 minutes, which exceeded the permissible exposure level of 85 dBA by 2.35 times, exposing employees to the hazards associated with hearing loss.   b) At the site, on or about June 25, 2019, the employer did not provide a hearing conservation program for employees who were exposed to a time weighted average (TWA) of 91.6 decibels on the A scale (dBA) or an equivalent dose of 123.9% for a run time of 390 minutes, which exceeded the permissible exposure level of 85 dBA, exposing employees to the hazards associated with hearing loss.
