29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a)  At the jobsite, on the roof, on or about 6/27/19:  Employees were installing roofing materials on the lower level of a 4:12 pitch multiple level roof, with a ground to eave height of 9 feet, and accessing that roof surface with an extension ladder that did not extend at least 3 feet above the landing being accessed.    b)  At the jobsite, on the roof, on or about 6/27/19:  Employees were installing roofing materials on the upper level of a 4:12 pitch multiple level roof, with a ground to eave height of 18 feet, and accessing that roof surface with an extension ladder that did not extend at least 3 feet above the landing being accessed.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):     a)  At the jobsite, on the roof, on or about 6/27/19:  Employees were installing roofing materials on the lower level of a 4:12 pitch multiple level roof, with a ground to eave height of 9 feet, without fall protection of any kind.    b)  At the jobsite, on the roof, on or about 6/27/19:  Employees were depicted on a video provided to the Syracuse AO working on both levels of a residential structure, with a 4:12 pitch and ground to eave heights of 9 feet and 18 feet, without fall protection of any kind.      Over the Top Roofing was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29CFR 1926.501(b)(13), which was contained in OSHA inspection number1323335, citation number 1, item number 1 and was affirmed as a final order on 7/30/18, with respect to a workplace located at 145 East Seneca Street, Oswego, NY  13126.    Over the Top Roofing was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29CFR 1926.501(b)(10), which was contained in OSHA inspection number 1157204, citation number 1, item number 1 and was affirmed as a final order on 9/24/16, with respect to a workplace located at Parklane Apartments & Townhomes, 208 North Main Street, North Syracuse, NY 13212.
