This condition exposed employees to a fall hazard of approximately 7 feet.

29 CFR 1910.140(c)(13)(i): The employer did not ensure that the anchorage point being used for the fall protection system was capable of supporting at least 5,000 pounds (22.2 kN) for each employee attached: (a)Orion Rigging Company, LLC at 47920 5th Street West, Canton, SD 57013: On or about and at times prior to July 2, 2019, the employer did not ensure that the anchorage being used for the fall arrest system was capable of supporting at least 5,000lbs. Employees were using a 2 ton (4000lb) trolley on the overhead crane as an anchor point for the employees working above four feet. This condition exposed employees to a fall hazard of approximately 7 feet.

29 CFR 1910.140(d)(2)(ii): Personal fall arrest systems were not rigged in such a manner that the employee cannot free fall more than 6 feet (1.8 m) or contact a lower level: (a)Orion Rigging Company, LLC at 47920 5th Street West, Canton, SD 57013: On or about and at times prior to July 2, 2019, the employer did not ensure personal fall arrest systems were rigged so that employees were not exposed to a free fall greater than six feet or contact a lower level. An employee was working on top of the muffle and connected to the trolley as anchorage which was approximately seven feet above the ground. The fall protection system was rigged in such a manner that the employee would contact the lower level in the event of a fall. This condition exposed employees to a fall hazard of over seven feet.

An employee was permitted to ride on the top of a 25/35 Hoist lift truck, model # FR25-35, serial # 30218 while in operation. This condition exposed an employee to fall, struck-by, and caught-in-between hazards.
