29 CFR 1910.28(b)(3)(iv): Each employee was not protected from falling into the ladderway platform hole at the entrance to the hole by a self-closing gate or an offset. a) On or about July 10, 2019, at the 12201 NW 25th St. Bldg C, FL 33182 bagging area south side, the employer did provide a self-closing gate or an offset at the ladderway platform hole for employees who were exposed to a five (5) feet nine (9) inches fall hazard, while working from the bagging machine platform. b) On or about July 10, 2019, at the 12201 NW 25th St. Bldg C, FL 33182 bagging area north side, the employer did provide a self-closing gate or an offset at the ladderway platform hole for employees who were exposed to a four (4) feet eleven (11) inches fall hazard, while working from the bagging machine platform.

29 CFR 1910.138(a): The employer did not select and require employee(s) to use appropriate hand protection when employees' hands were exposed to hazards such as those from skin absorption of harmful substances; severe cuts or lacerations; severe abrasion; punctures; chemical burns; thermal burns; and harmful temperature extremes: On or about July 10,2019, at the 12201 NW 25th St. Bldg. C Miami, FL 33182, the employees were exposed to chemical (caustic) burns while handling cement mix bags containing Portland Cement a corrosive (with a pH of 13), and not having appropriate hand protection.
