29 CFR  1910.1053(i)(1)(i): The employer did not make medical surveillance available at no cost to the employee, and at a reasonable time and place, for each employee who was occupationally exposed to respirable crystalline silica at or above the action level for 30 or more days per year:  a)  At the facility on or about March 20, 2024 - Employees were not provided with an initial medical evaluation when exposed to silica above the action level for 30 days or more.   A production employee had an exposure to Silica at an airborne concentration of 32 ug/m3.  This is approximately 1.28 times the action level 25 ug/m3.  Sampling was conducted on March 20, 2024 for 450 minutes and zero exposure was assumed for the unsampled portion of the shift.  b)  At the facility on or about March 20, 2024 - Employees were not provided with an initial medical evaluation when exposed to silica above the action level for 30 days or more.  A Production employee had an exposure to Silica at an airborne concentration of 46 ug/m3.  This is approximately 1.48 times the action level 25 ug/m3.  Sampling was conducted on March 20, 2024 for 448 minutes and zero exposure was assumed for the unsampled portion of the shift.
