29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment were used to support scaffold platforms when they were not specifically designed by the manufacturer for such use:  A. On or about July 9, 2019 at the worksite, two employees had fabricated and used a 4 foot wide by 5 foot long x 4 foot high, plywood box, tied to the forklift blades of a 2013, JCB500 Loadall, Off Road forklift with plastic straps, to elevate one employee to a height of 16 feet in order for him to nail off plywood wall sheathing of a three story commercial structure. The plywood box was not designed or manufactured for such use exposing the employee to a 16 foot fall hazard.

29 CFR 1926.451(c)(2)(v): Fork-lifts were used to support scaffold platforms while the entire platform was not attached to the fork and the fork-lift was moved horizontally while the platform was occupied:  a. On or about July 9, 2019 two employees had utilized a 2013 JCB500 Loadall Off Road Forklift to elevate one employee in a plywood box, only secured to the forklift by straps in the top corners of the box,  so he could nail off wall sheathing on a 3 story commercial structure. The forklift operator had moved the employee side to side horizontally while he was in the box so he could complete his task, exposing the employee to a 16 foot fall hazard.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.  a. The employer fails to assure effective protection against falls as required by the standard, as demonstrated on July 9, 2019, when one employee working in a fabricated 4 foot wide by 5 foot long x 4 foot high, plywood box, tied to the forklift blades of a 2013, JCB500 Loadall, Off Road forklift with plastic straps, to elevate the employee to a height of 16 feet in order for him to nail off plywood wall sheathing of a three story commercial structure. The employee is not protected by any means of personal fall protection guardrails or safety nets, exposing him to a 16 foot fall hazard.  First Prime Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29CFR 1926.501(b)(13), which was contained in OSHA inspection number 1319995, citation number 1, item number 1 and was affirmed as a final order on 08/06/2018, with respect to a workplace located at Rainier Lanelot 21 - Seagrove Beach Santa Rosa Beach, FL 32459.

29 CFR 1926.1052(c)(12): Unprotected sides and edges of stairway landings were not provided with guardrail systems that meet the criteria contained in Subpart M of 29 CFR 1926.  a. The employer fails to assure effective protection against falls as required by the standard, as demonstrated on July 9, 2019, when employees are using an extension ladder to access the second floor and completing interior framing on the second floor of a three story commercial structure at 328 Seabreeze Dr, Panama City Beach, FL 32413, without fall protection and are exposed to falls of approximately 11 feet 6 inches to the ground below.  First Prime Construction, Inc was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1052 (C)(1)(II), which was contained in OSHA inspection number 1319995, citation number 1, item number 2 and was affirmed as a final order on August 6, 2018, with respect to a workplace located at Rainier Lanelot 21 - Seagrove Beach Santa Rosa Beach, FL 32459 .
